If he had used the image as inspiration and drew it by hand, I wouldn't have said a word, because his creation would have been his but inspired by someone else. That's not the case here. He took someone else's wallpaper, changed 2 things, threw some text on the image and submitted it. That's not creative, that's cheating. And he didn't even have the decency to credit the original image.
