Nice speech (not sarcasm). But let me tell you something. FYI Digimon is the one who copying first. They copy the evolution, they copy the title, and the fact all digimon lay eggs and have partner/trainer. They know about pokemon yet they still released it anyway without knowing the consequence of being accused rip-off. So if Pokemon copying Digimon now, I won't be to surprised cause its probably a PAYBACK. Pokemon was in this situation before. If you play Pokemon GSC, the city where player lives called New Bark City was to be called Silent Hill in early concept because the city based on Shizuoka city and Shizuoka means Silent Hill. But 6 months before the game released, a Horror genre game of the same name (Silent Hill) released so they change it because they don't want to be accused rip-off the name or maybe they don't want to be compared to a horror games. But the most vital think is title. I heard from some people that Pokemon ripped off Shin Megami Tensei and nobody give a damn about it. You know why? Because its title is different. That is one of the most vital point for a games or any art for that matter, cause title represent their identity. SMT also has different atmoshpere. Its dark, bloody, and demonic. Not to suitable for kids and they don't use the term evolution like Pokemon do. People will recognize the similarities between two series from the title first and then from its content. The term that used in both Digimon and Pokemon for them to transform is the same. My advice to Digimon (though its too late now):
"if you don't want to be accused a rip-off, change the title and change some term that similar to Pokemon like evolution. Don't pout if you turn out to be the one that came with the idea of the naming and the term first. Change doesn't always hurt. You got two years after Pokemon released. You must know about its popularities if you live in Japan or in USA. If you don't want to be compared to other big franchises, you should change the title into less similar with your rival to create your own identity that differ from the other. And then change the term "evolution" into something else. Naming and terms may sound trivial but this is actually can be vital point to strategize your franchise distribution."
