So, you have a scan of this ad or the periodical it was in? How crappy was the trace?
Watermarks don't do jack if someone wants to trace over the work, it just keeps them from claiming/using it in the original state. I use them on my original works, but not on fan art.
Hmm..also noticed you never put copyright info on your images here..why not? It's almost the same as saying you are claiming ownership. I always slap on copyright info so my a** doesn't get nailed by W.B or anyone else I'm drawing in homage to, no matter where the image ends up. It's like a form or respect... even though the really determined could use the stamp tool to remove it.
In general this is just what you risk anytime you post things to the net, it's the nature of the beast. Fanworks are in grey area since you have no legal rights unless you are a licensed artist for whichever company said characters belong to, or the work was commissioned for some other publication that claims sole or first rights to it. I agree is sucks that your stuff gets ripped, but
There's not much point in agonizing greatly over this with fan works. Save it for when some a**hole tries to rip off your self created copyrighted characters.
ps. Here in the U.S. the 'Orphan Works' bill that's been trying to get it's ugly toe in the door for years, is being revised this year but it's hard to say if it will fly since quite a few organizations such as the Graphic Artists Guild are active in trying to make artists aware of it's progress. The way it came off at first is like the rip off situation you describe above, so yeah..many are watching it with pitchforks poised.

Believe me Marcos, I know how you feel. It majorly sucks. Last year someone stole one of my fics, translated it in French and posted it on a site as a work of his/her own. My cousin, who reads French fanfics found out about it eventually and I had to report him/her and prove this was my individual work. Not an easy thing done.

A work is a work, and, when someone does a thing out oflove for it, it´s rahter hard to acceptt hat someone else who didn´t shard the feeling just take it as theirs merely to brag it as theirs... I can almost pity those, though I don´t support their attitude, as their "glory" stands shorter than the shame thereafter, when exposed - but, to take form works of fanart to make profits??

Marcos have you tried putting the deviant art trademark across your work? I know that if someone save the work, it cannot remove it. I know it sometimes do injustice to the piece but at least they will not be able to use the work without your permission (as you are the only one able to remove it anyway).

Also have you thought of commissions?
Yes I purely understand this. I tell you, it sucks.

Actually,

I never wanted to( most of my postings are fanart, so I think it´s not right to claim those as fully mine, because those regard about characters that aren´t my own...

And that´s why I stress on crediting the creator son the author comments feature; besides, if someone just wants to have fun doing color to those, the whole DA trademark just makes it impossible; actually, I do those fanarts for sharing.

I assume South-America has the same "problem" as now the USA

as you probably already heard, the USA wants to release a new copyrights law, that would basically cause the same "stuff" as you are dealing with
