Look in the link you gave. It says rather clearly:
"Date added: Jun 22, 2007"
Now, the one here says:
"Submitted: January 19"
deviantART doesn't add the year if it's in '07, which means that it was submitted on January 19, 2007.
January 19, 2007 comes before June 22. Did you know this?
Also, look at the filename of the picture from the link you gave.
"Filename: Apple_Wallpaper_by_flashrevolution.jpg"
IT EVEN STATES THAT IT WAS MADE BY THIS PERSON.
This all means that ~flashrevolution did no stealing, it was the link that you gave that did the stealing.
