Byakuya doesnt stand up to the rules either, but he is a captain. If he was in her place he would also just go along with the punishment because after all Rukya did break the rules. As far as captains are concerned, up to the end of the first Arc it just looked like whoever had a bankai and captain level spiritual energy would be a captain.
For example Komamura or Feng are both captains, but Feng only follows Yuruichi around and Komamura is a super boring character.
